Terms of Use

These Terms of Use ("Terms") are an agreement between you and [Developer legal name], [address] ("we", "our", "the developer"), and govern your use of the KickOff iOS application ("the App"). By downloading, installing, or using the App, you agree to these Terms. This agreement is between you and us only — Apple is not a party to it, except as set out in Section 12.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use the App. By using the App, you represent that you meet this requirement.
2. Acceptance of Terms
If you do not agree to these Terms, do not use the App. We may update these Terms from time to time; continued use of the App after changes constitutes acceptance of the revised Terms.
3. License to Use
Subject to these Terms and the Usage Rules in Apple's App Store Terms of Service, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the App for your personal, non-commercial purposes on any Apple-branded device that you own or control, as permitted by the Usage Rules.
4. User Conduct
You agree not to:
- Reverse-engineer, decompile, or disassemble the App except as permitted by law.
- Use the App for any unlawful purpose or in a way that could damage, disable, or impair its operation.
- Attempt to gain unauthorized access to any systems or networks connected to the App.
- Use automated means (bots, scrapers) to access the App or its underlying data services.
5. Football Data & Predictions
Match data, statistics, and predictions are provided "as is" for informational and entertainment purposes only. This data is sourced from a third-party provider and may be delayed, incomplete, or inaccurate. Predictions are statistical estimates, not guarantees. The App does not offer betting, gambling, or financial advice, and predictions must not be relied upon for wagering or any other decision-making purpose. You are solely responsible for complying with the gambling and betting laws of your jurisdiction if you choose to use this information in connection with any such activity.
6. Push Notifications
Push notifications (kickoff reminders, goal alerts, full-time results) are optional and delivered via a third-party push provider (OneSignal). Delivery timing is not guaranteed and may be delayed or fail due to factors outside our control (network conditions, OS restrictions, provider outages). See our Privacy Policy for what data this involves.
7. Intellectual Property
The App, including its design, code, and content (excluding third-party football data and team/league marks, which belong to their respective owners), is owned by us or our licensors and protected by applicable intellectual property laws. If you believe content in the App infringes your intellectual property rights, contact us at support@kickoff-sports.app.
8. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to accuracy, reliability, or fitness for a particular purpose, to the maximum extent permitted by law.
9. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the App.
10. Termination
We may suspend or discontinue the App or your access to it at any time, without notice, for any reason.
11. Governing Law
These Terms are governed by the laws of [jurisdiction], without regard to conflict-of-law principles, except where mandatory consumer-protection law in your country of residence requires otherwise.
12. Additional Terms Required by Apple
Because the App is distributed through the Apple App Store, the following terms also apply, as required by Apple:
- This agreement is concluded between you and us alone, not Apple, and we — not Apple — are solely responsible for the App and its content.
- Your license to use the App is limited to Apple-branded products that you own or control, and as permitted by the App Store's Usage Rules.
- We, not Apple, are solely responsible for providing any maintenance and support for the App. Apple has no obligation whatsoever to furnish any maintenance or support for the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App (if any) to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our sole responsibility.
- We, not Apple, are responsible for addressing any claims from you or a third party relating to the App or your possession/use of it, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
- In the event of a third-party claim that the App, or your possession and use of it, infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement, and discharge of any such claim.
- You represent and warrant that you are not located in a country subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- You must comply with any applicable third-party agreement (for example, your wireless data service agreement) when using the App.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
13. General
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. We may assign these Terms in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.
